These Terms and Conditions (the “Terms”) govern your access to and use of the Brine Oyster House website located at https://brineoysterhouse.com/ and any related online features, as well as in‑person services such as reservations, events, gift card purchases, and communications (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who We Are

2. Eligibility and Account Features
Use of the Site is intended for individuals who are at least 13 years old. Some features may allow or require you to submit information, such as for reservations or gift card purchases. You are responsible for providing accurate information and for any activity that occurs through your submissions.
3. Reservations, Seating, and Cancellations
Reservations may be made through the Site or via third‑party platforms. Third‑party terms apply in addition to these Terms. Seating policies, last seating times, and walk‑in availability can change at any time. A no‑show or late cancellation may be subject to a fee or deposit forfeiture if such a policy is disclosed at the time of booking.
4. Private Events and Large Parties
Private dining and events may require a signed agreement, deposit, and minimum spend. Cancellation windows and fees will be stated in the event agreement. Brine reserves the right to refuse, reschedule, or cancel events that present safety concerns or violate house policies or applicable laws.
5. Menu, Pricing, and Availability
Menus, pricing, hours, live music schedules, and offerings may change without notice. Items can be limited in quantity. Raw or undercooked seafood and other foods may increase the risk of foodborne illness. Guests who have allergies or dietary restrictions should inform staff. Efforts are made to accommodate requests, yet cross‑contact cannot be fully eliminated in a working kitchen and bar.
6. Alcohol Policy
Guests must be at least 21 years of age to purchase or consume alcoholic beverages and may be asked to present a valid government‑issued photo ID. Brine reserves the right to refuse service consistent with applicable law.
7. Gift Cards
Gift cards are redeemable for eligible goods and services at Brine Oyster House. Gift cards are not refundable and are not redeemable for cash, except where required by law. Lost or stolen cards will not be replaced, except as required by law and with proof of purchase. Additional terms provided at the time of purchase apply.
8. Payments and Billing
Payments for reservations, deposits, events, or gift cards may be processed by third‑party payment processors. Brine does not control and is not responsible for third‑party systems. You authorize charges for applicable amounts, taxes, and fees. Chargebacks and disputes may result in reservation cancellation or hold on future bookings, consistent with applicable law.
9. User Conduct
You agree not to misuse the Services or interfere with their normal operation. Prohibited conduct includes attempting to access systems without authorization, introducing malware, scraping data, or using the Services for fraudulent or illegal purposes.
10. Intellectual Property
The Site, its design, logos, text, images, video, and other content are owned by or licensed to Brine and are protected by intellectual property laws. You may view the Site for personal, non‑commercial use. Any reproduction, distribution, modification, public display, or creation of derivative works requires prior written permission from Brine or the rights holder.
11. Reviews, Photos, and User Submissions
If you post reviews, tag Brine on social media, or submit photos or feedback to Brine, you represent that you have the right to share that content. You grant Brine a non‑exclusive, royalty‑free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform that content in any media for marketing, promotional, and operational purposes, subject to applicable law and platform rules. Brine may moderate or remove submissions at its discretion.
12. Third‑Party Services and Links
The Services may link to third‑party platforms such as reservation tools, payment processors, gift card vendors, delivery partners, or social media. Those services are governed by their own terms and policies. Brine is not responsible for third‑party content, accuracy, or practices.
13. Privacy
Brine respects your privacy. The collection and use of personal information are described in our Privacy Policy, which forms part of these Terms. Please review the Privacy Policy posted on the Site.
14. Accessibility
Brine strives to make the Site and in‑person experience accessible and welcoming. Feedback about accessibility can be directed to the contact information in Section 1.
15. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. Availability of the Site and accuracy of content are not guaranteed.
16. Limitation of Liability
To the maximum extent permitted by law, Brine and its owners, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or use, arising out of or related to the Services or these Terms, even if advised of the possibility of such damages. Total liability for any claim will not exceed the amount paid, if any, by you to Brine for the Services that gave rise to the claim during the twelve months preceding the event giving rise to liability. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
17. Indemnification
You agree to indemnify and hold harmless Brine and its owners, officers, employees, and agents from and against all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services, your submissions, or your violation of these Terms or applicable law.
18. Force Majeure
Brine will not be liable for any delay or failure to perform due to events outside its reasonable control, including but not limited to acts of God, labor disputes, power failures, internet outages, equipment failures, government actions, public health events, or severe weather.
19. Governing Law and Venue
These Terms are governed by the laws of the State of Michigan, without regard to conflict‑of‑law principles. You agree to the exclusive jurisdiction and venue of the state courts located in Wayne County, Michigan, or the United States District Court for the Eastern District of Michigan for any dispute that is not subject to informal resolution under Section 20.
20. Dispute Resolution
Parties will first attempt to resolve disputes informally by contacting the other party using the information in Section 1. If a dispute is not resolved within thirty days, either party may pursue available remedies in court as identified in Section 19. Small claims actions may be brought in a court of competent jurisdiction.
21. Changes to These Terms
Brine may update these Terms at any time. The Effective date at the top will reflect the latest revision. Continued use of the Services after an update means you accept the updated Terms.
